1. General Terms
These General Terms and Conditions (hereinafter "Terms") govern the contractual relationship between KonCafe (hereinafter "we", "us", or "the Company") and you, the customer (hereinafter "you" or "Customer"), regarding all orders placed through our website koncafe.com.
By placing an order on our website, you agree to be bound by these Terms. We recommend that you read them carefully before making a purchase. These Terms apply exclusively; any conflicting or deviating terms of the Customer shall not be recognized unless we expressly agree to their validity in writing.
We reserve the right to modify these Terms at any time. The version of the Terms applicable to your order is the one in effect at the time of placing the order.
2. Ordering Process
2.1 Contract Formation
The presentation of products on our website does not constitute a binding offer but rather an invitation to submit an order (invitatio ad offerendum). By clicking the "Place Order" button, you submit a binding offer to purchase the products in your shopping cart.
You will receive an automatic order confirmation by email, which only acknowledges receipt of your order and does not constitute acceptance. The contract is concluded when we send the shipping confirmation or deliver the goods.
2.2 Order Verification
We reserve the right to verify any order before acceptance. We may refuse orders if there are concerns about payment, suspected fraud, or if the products are unavailable. In such cases, we will inform you promptly and refund any payments already made.
2.3 Customer Account
You may place orders as a guest or create a customer account. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
3. Prices and Payment
3.1 Prices
All prices displayed on our website are in Euros and include applicable VAT (Value Added Tax) at the statutory rate. Shipping costs are displayed separately and added during checkout before you finalize your order.
Prices are subject to change without notice. However, the price applicable to your order is the price displayed at the time you place your order.
3.2 Payment Methods

3.3 Payment Terms
Payment is due immediately upon order placement for credit card, PayPal, and instant payment methods. For bank transfers, payment must be received within 7 days of order confirmation.
3.4 Retention of Title
The goods remain our property until full payment has been received. You may not pledge, transfer as security, or otherwise dispose of the goods before title has passed to you.
4. Delivery
4.1 Delivery Area
We deliver to all countries within the European Union, as well as Switzerland, Norway, and the United Kingdom. Delivery to other countries may be available upon request.
4.2 Delivery Times
Delivery times vary depending on the destination country and are indicated during checkout. Standard delivery times are:
- Western Europe: 2-4 business days
- Southern Europe: 3-5 business days
- Northern Europe: 3-5 business days
- Eastern Europe: 4-7 business days
- United Kingdom: 5-8 business days
These are estimated times and may be affected by circumstances beyond our control. Orders placed before 2:00 PM CET on business days are typically dispatched the same day.
4.3 Shipping Costs
Shipping is free for orders over EUR 150. For orders below this threshold, shipping costs depend on the destination country and are clearly displayed during checkout.
4.4 Risk of Loss
The risk of loss or damage passes to you upon delivery. If you are a consumer, risk passes when the goods are handed over to you or a person designated by you.
5. Right of Withdrawal
5.1 Withdrawal Right
As a consumer, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day on which you, or a third party other than the carrier indicated by you, acquires physical possession of the goods.
5.2 How to Exercise Withdrawal
To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or email). You may use the model withdrawal form available on our website, but it is not obligatory.

5.3 Effects of Withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including the costs of delivery (except for the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw.
We will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. You shall bear the direct cost of returning the goods.
5.4 Exceptions to Withdrawal
The right of withdrawal does not apply to:
- Sealed goods which are not suitable for return due to health protection or hygiene reasons, if unsealed after delivery
- Goods made to the customer's specifications or clearly personalized
- Goods which are liable to deteriorate or expire rapidly
6. Warranty and Liability
6.1 Legal Warranty
All products sold by us come with the statutory warranty for defects (Gewahrleistung) as provided under German law. For consumers, the warranty period is 24 months from delivery. For businesses, the warranty period is 12 months.
6.2 Defect Notification
If you discover a defect, please contact our customer service immediately. We will arrange for repair, replacement, or refund as appropriate under the applicable warranty provisions.
6.3 Manufacturer Warranty
Some products come with an additional manufacturer warranty. The terms and conditions of such warranties are provided by the respective manufacturers and do not affect your statutory warranty rights.
6.4 Limitation of Liability
Our liability for damages is limited to intent and gross negligence. In cases of simple negligence, we are only liable for breach of essential contractual obligations (cardinal obligations), and our liability is limited to the foreseeable, contract-typical damage. This limitation does not apply to damages arising from injury to life, body, or health.
7. Dispute Resolution
7.1 Online Dispute Resolution

7.2 Consumer Arbitration
We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
8. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer habitually resident in the EU, you also enjoy the protection of mandatory provisions of the law of your country of residence.
For merchants, legal entities under public law, or special funds under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Berlin, Germany.
9. Severability
If any provision of these Terms is or becomes invalid, illegal, or unenforceable, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
